I have a small beef w/ DSK Jewelry

As you all know, Bubbi is very much a fan of DSK Jewelry, and I do think they make lovely jewelry. And the maker, Stephi, had some pretty simple designs.

There was one blog Stephi posted that made me question some of her pieces though. Out of the simple pieces of jewelry, she said that she created these with an artistic eye and there was one person who was making her angry, the reason being is that she has been selling very (if not the same) jewelry she is selling.
Her formula for the necklaces is often just:

Swarvoski crystals + Bail + chain = DSK Jewelry.

My problem with DSK merchandise is that some of these are just too simple to imitate. And as long as Stephi is using Swarvoski crystals, there will be many people who will have or make similar jewelry pieces to hers. I know it's patented and she can technically sue, I have to question, how much creativity is going into it and how much originality it has if someone can easily imitate it. All I have to do is buy chains, the crystals and the bails and I would have my own necklaces that looks like it's made by DSK. Heck, there's a lady who sells similar if not identical jewelry to Stephi's for cheaper.

Before I knew DSK Jewelry existed, I was very much into Swarovski crystals so I had bought some. One of them I made into a cell phone charm that IS the exact same thing Stephi was selling on the website. And that was many months after I had made my own cell phone charm. Although it's not right to say she copied me or I copied her, would she have the right to get angry if I had marketed the cell phone charm?
At my craft store they were having sales of Swarvoski crystals, I went all out crazy and bought many of them and turned them into necklaces.
. What if one of the pieces I combined ends up on the DSK jewelry while I marketed, who ripped of who then?

I guess I am questioning some of the DSK Jewelry. For pieces that are admittedly complex, then those are fine. But for the simple pieces? It's kind of like putting a patent on chocolcate chip cookies, and if someone bakes their own and sells them, it's copying.
Take the Snowflake necklace (AB crystal) - I've seen that necklace many times NOT made by DSK Jewelry, heck I have one. And all i did was by the pendant.

For example, here is one of my design:
Red Siam Heart + Leaf = One different simple piece for Christmas (as the colors a themed that way).

My question is, if the designs were that original, then why should it be easy for someone else to come up with the idea.

Her pieces are WAYY too expensive too.
Is the chains she use sterling silver or so ??K gold?

Yeah, I believe some of it is gold but I don't know the specifics, plus shipping and labor. That's why it's expensive. The crystals aren't cheap either. The price also depends on the length of chain.

I don't consider them really original...just pretty. Maybe it's the battle of whoever has creativity strikes first?

I agree.

I actually found all the materials needed to make the same things she makes at Hobby Lobby. I made about 4 necklaces that look exactly the same as hers for $10. I for one, am not going to pay $40-$50 for something I could make for $10...especially when then $10 one looks just as pretty and of good quality. :roll:

DSK Jewelry cannot really sue anyone for making products similar to their own unless the products in question were marketed under their company name (DSK Jewelry) without permission. The very fact that the products they sell are hand-made using third-party products makes it impossible to have any legal ownership of the 'designs'.

I have heard about cases of threats on taking legal action by DSK Jewelry, and that is simply disturbing considering that supposedly her boyfriend is a lawyer.

I assure you that there is no way she could win in any court procedure. What would be the basis for her lawsuit? Using the same materials she uses? Stealing her idea of making 'jewelry'? Nonsense.

Now, if she made her jewelry with meteor rocks produced in her Meteor-refinement factory, using samples especially gathered by her Space Materials Collecting company, then maybe she would have basis for a copyrights violation lawsuit =P

I agree ! they are waaaay too over priced and she sued someone on youtube for making something thats similiar to her necklace. thats just ridiculous, its not like shes the only one that can make those designs
